The rules that govern use of our services.

By using the service you declare you have legal capacity to contract and accept these Terms together with the Personal Data Processing Policy. If you don't agree with any part, refrain from using the service.

Dinnartec offers software-as-a-service (SaaS) solutions, including management platforms, specialized modules, integrations, and AI-powered tools. The service is delivered over the internet and its features may evolve over time.

You're responsible for the information you provide when creating your account, for keeping it up to date, and for the confidentiality of your credentials. You're responsible for all activity carried out from your account. You must notify us immediately of any unauthorized use.

The service is offered under monthly or annual subscription plans, with recurring charges according to the chosen plan. Prices may be expressed in USD or other currencies, and applicable taxes are charged additionally where required.

We may modify prices and plans with reasonable advance notice. New prices apply to the next billing cycle, unless you cancel before they take effect.

Payments are processed through certified external gateways. By activating a subscription, you authorize the recurring charge of the plan amount in each billing cycle, until you cancel.

If a payment can't be processed, we may suspend access to the service until the situation is resolved. Retry attempts may be performed automatically.

You can cancel your subscription at any time from the platform or by writing to hello@dinnartec.com. Cancellation takes effect at the end of the current billing cycle. You retain access until that date and no additional charges are generated.

Unless otherwise required by law or by a specific promotion, payments already made are non-refundable.

When we offer free trials, the specific terms and conditions communicated at activation apply. If you don't cancel during the trial period, the subscription activates automatically under the selected plan.

You agree to use the service lawfully and in accordance with these Terms. The following are not permitted:

• Using the service for unlawful or fraudulent purposes, or in ways that violate third-party rights.
• Attempting unauthorized access to accounts, systems, or networks.
• Reverse-engineering, decompiling, or copying the software.
• Overloading the infrastructure, distributing malware, or bypassing security mechanisms.
• Reselling, sublicensing, or commercially exploiting the service without express authorization from Dinnartec.

You retain ownership of the data and content you upload to the service (Customer Content). You grant Dinnartec a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display that content strictly as needed to provide and improve the service.

This license includes the use of Customer Content to train, fine-tune, and operate AI models and agents, in accordance with the Personal Data Processing Policy and applying aggregation or anonymization techniques where appropriate.

The software, brand, designs, documentation, and other elements of the service are the exclusive property of Dinnartec or its licensors. No intellectual property rights are transferred beyond the limited right to use under these Terms.

The service may integrate with external platforms and providers. The use of those integrations is also governed by the third party's terms. Dinnartec is not responsible for the availability, content, or changes of third-party services.

We make reasonable efforts to keep the service available, but we don't guarantee uninterrupted availability. We may perform maintenance windows, updates, and improvements, aiming to minimize impact on operations.

Support is provided through the official channels according to the contracted plan. Scope, response times, and conditions are defined in the documentation of the corresponding plan.

We may suspend or terminate access to the service in case of breach of these Terms, non-payment, security risk, or legal obligation. After termination, access to Customer Content may be limited within reasonable timeframes.

The service is provided “as is” and “as available”. To the maximum extent permitted by law, Dinnartec is not liable for indirect damages, loss of profits, or loss of data arising from the use or inability to use the service.

Dinnartec's total aggregate liability to the customer is limited to the amount paid by the customer in the twelve (12) months prior to the event giving rise to the claim, for the affected service.

You agree to hold Dinnartec harmless against third-party claims arising from your improper use of the service or from violations of these Terms.

We may update these Terms at any time. We'll communicate changes through reasonable means. Continued use of the service after the effective date implies acceptance of the new version.

These Terms are governed by the laws of the Republic of Colombia. Disputes will be submitted to the competent courts of Dinnartec's domicile, unless otherwise required by law.
